Stock art, clip art, and photographs


Any digital images, stock photographs, clip art, or other artistic work (collectively "images") delivered with any Tom Jenkins of The Photo College (aka PC) copyrighted product may be used in accordance with the rights set out in the End-User License Agreement that ships with that TPC product. If your intended use falls within the terms of the End-User License Agreement or other product documentation, further written permission is not required.

Please note that images contained on TPC's Books, Website, and Software may not be used except as provided in the EULA guidelines.

Any use of images delivered with a TPC product and not provided for in the End-User License Agreement, requires written permission from Tom Jenkins of The Photo College. In some instances, images included in the TPC products may be owned by a third party and licensed under terms different than those contained in the TPC End-User License Agreement. Under these circumstances, the Terms of Use for third-party images are stated in ReadMe or text files associated with that image. If you are seeking to use third-party images or content outside the scope permitted in the terms of the ReadMe or text files, please contact the copyright owner directly for permission. It is unlikely that TPC will be able to grant permission beyond that contained in the End-User License Agreement due to contractual restrictions, third-party rights, and other intellectual property restraints.

If you are still interested in requesting special permission for a TPC image, please submit your request by e-mail. Please allow two weeks for your request to be processed.

Under no circumstances will TPC license the reproduction, distribution, or modification of any third-party images displayed on thephotocollege.com.

 

Box shots


TPC product box shots are complete images of TPC product boxes. You may not use TPC box shots on third-party software packaging, but you may use box shots without TPC's written permission in advertising, on documentation (including educational brochures), in tutorial books, in videotapes or on Websites, provided you adhere to the following guidelines:
1. Your use may not be obscene or pornographic, and may not be disparaging, defamatory, or libelous to TPC, any of its products, or any other person or entity.
2. Your use may not directly or indirectly imply TPC sponsorship, affiliation, or endorsement of your product or service.
3. You may not use the box shot in a comparative advertisement.
4. You may not use any of TPC's box shots as a link to your Web site. See linking to TPC's Web site for proper linking guidelines.
5. You may not alter the box shot in any way except to resize the entire box shot while maintaining the original quality of display resolution. Your use must contain the entire box shot. Any images contained within the box shot (i.e., the TPC Logo, the The OriJen Publications Logo, "Capture the Moment", "Exercise for the Mind") cannot be used independently of the entire box shot.
6. The box shot is not the most prominent visual element on the material where the box shot is displayed. Your company name and logo, your product, and/or your graphics should be significantly larger than the box shot.
7. You must include the following copyright attribution statement: "The Photo College product box shot(s) reprinted with permission from Tom Jenkins of The Photo College".
8. If your use includes references to a TPC product, the full name of the product must be referenced at the first and most prominent mention. When referencing any TPC trademarks, please mark with a ™ or ® as indicated in The Photo College trademark database for general distribution.
9. If your use includes references to any TPC trademarks, you should include the following trademark attribution statement: "[List of marks used, with "Tom Jenkins of The Photo College" first, if used, followed by other TPC marks used, in alphabetical order] are either registered trademarks or trademarks of Tom Jenkins of The Photo College in the United States and/or other countries."

If your use meets the above criteria, no further written permission is required. For use by the press in articles or other news reports, please contact TPC from our Homepage, http://thephotocollege.com. All other uses require written permission from Tom Jenkins of The Photo College, including use of box shots in or on a television program, movie, or commercial. Screen shots


Screen shots are individual print screens contained within TPC software applications. You may use screen shots in advertising, on documentation (including educational brochures), in tutorial books, in videotapes, or on Web sites, provided you adhere to the following guidelines:
1. Your use may not be obscene or pornographic, and may not be disparaging, defamatory, or libelous to Tom Jenkins of The Photo College, any of its products, or any other person or entity.
2. Your use may not directly or indirectly imply TPC sponsorship, affiliation, or endorsement of your product or service.
3. You may not use the screen shot in a comparative advertisement.
4. You may not alter the screen shot in any way except to resize the screen shot. Your use must contain the entire screen shot. You may not use portions of the screen shots and no portions of a screen shot may be included in your product user interface.
5. You may not use screen shots from other TPC products that have not been commercially released by Tom Jenkins of The Photo College.
6. You may not use screen shots that contain third-party content.
7. You must include the following copyright attribution statement: "The Photo College product screen shot(s) reprinted with permission from Tom Jenkins of The Photo College."
8. If your use includes references to a TPC product, the full name of the product must be referenced at the first and most prominent mention (i.e., Photographic TEchniques, Book I, Portrait Studio Design & Operation, Photography's Timeless Techniques, Book II). When referencing any TPC trademarks, please mark with a ™ or ® as indicated in the TPC trademark database for general distribution.
9. Screen shots must be reproduced in their entirety. Permission may be given in certain limited circumstances, however, to use specific portions of a screen shot. For permission to use a screen shot in this manner, contact TPC from our Homepage.

All uses of material displayed on thephotocollege.com are governed by the terms and conditions contained therein. Please see Terms of Use for additional information and specific use guidelines.

 

Linking to TPC's Web site


If you would like to provide a link from your Web site to a TPC Web page (for example, "www.thephotocollege.com"), you may use a textual URL or one of the Web logos provided below, as appropriate. You may not use the TPC corporate logo or any other TPC logo or graphic to link to www.thephotocollege.com, or any other TPC Webpage.

 

Guidelines for use of thephotocollege.com Web logo


The thephotocollege.com Web logo is provided solely as an indicator of a link to TPC's official Website. By downloading or using the Web logo, you agree to adhere to the following guidelines:
1. You may only display the Web logo on your Website, and not in any other manner. It must always be an active link to http://www.thephotocollege.com.
2. The Web logo must appear by itself, with a minimum spacing (the height of the Web logo) between each side of the Web logo and any other graphic or textual elements on your Webpage.
3. You may not alter the Web logo in any manner, including size, proportions, colors, elements, etc., or animate, morph, or otherwise distort its perspective or appearance.
4. Your use may not be obscene or pornographic, and may not be disparaging, defamatory, or libelous to TPC or OriJen Publications, any of its products, or any other person or entity. You may not link to thephotocollege.com from a Website that is obscene or pornographic, or disparaging, defamatory, or libelous to TPC or any of its products.
5. Your use may not directly or indirectly imply TPC's sponsorship, affiliation, or endorsement of your product or service.
6. Your use may not infringe any Tom Jenkins of The Photo College intellectual property or other rights, may not violate any state or federal laws, and must comply with international IP laws.
7. You may not create a frame or border environment around TPC content.
8. You may link to, but may not replicate, TPC content.
9. You may not present false or misleading information about TPC products or services.
10. Your reference to TPC, its products, and its Website must comply with the general trademark guidelines.
11. While you may use the Web logo as provided by these guidelines, you may not use the TPC corporate logo or any other TPC logo or graphic to link to thephotocollege.com.
12. These guidelines do not grant permission to use any other TPC logos or trademarks. Tom Jenkins of The Photo College reserves the right in its sole discretion to terminate or modify your permission to display the Web logo at any time.

Use of TPC trademarks in titles of books

TPC trademarks may be used in the titles of books, in printed form, that provide in-depth training on TPC products beyond that available from TPC product tutorials, Email support, and reference material. Publishers of such books need not obtain express permission from TPC if the use of TPC trademarks complies with all of the following guidelines:

1. The TPC trademarks may not appear larger or more prominent than the rest of the full book title.

2. The TPC trademarks may not be used in the stylized form used by TPC, and no TPC logos or product or box shots may be used on your book's cover, advertising, promotional material, or otherwise, without express written permission from Tom Jenkins of The Photo College.

3. You may not shorten or abbreviate any of TPC's trademarks. Always spell and capitalize TPC's trademarks exactly as they appear in the TPC trademark database for general distribution. If you are distributing materials exclusively in Japan, further written permission from Tom Jenkins of The Photo College is required.

4. You include the following trademark attribution statement: "[List of marks used, with "The Photo College" first, if used, followed by other TPC marks used, in alphabetical order] are either registered trademarks or trademarks of Tom Jenkins of The Photo College in the United States and/or other countries."

5. You include a conspicuous disclaimer, preferably on the front or back cover of the book, but at a minimum it must appear on the copyright page of the book and state in all capital letters: THIS PRODUCT IS NOT ENDORSED OR SPONSORED BY TOM JENKINS OF THE PHOTO COLLEGE OR ORIJEN PUBLICATIONS, PUBLISHER OF [INSERT THE PHOTO COLLEGE PRODUCT NAME(S)].

6. You otherwise comply with Guidelines for Third Parties Who Use TPC's Trademarks.

7. There is nothing else in the use of TPC's trademarks or in the circumstances that would lead consumers to believe there is an association with, or endorsement by, TPC that does not exist, and the TPC trademarks are used only to refer to the TPC products that are the subject of the book.
