Thanks for choosing TPC. Please be aware that we are constantly upgrading both TPC and the glossary and will notify you of updates. Should you ever change the email address you use during registration you should notify us of such. You can also check the web page for notices of upgrades just in case you forget to notify us of any email change. The Student ID and Password you were issued will be required for receiving any changes and upgrades; safeguard them.
Please make sure you have downloaded and installed the latest version of Adobe Acrobat Reader before downloading any of TPC's .pdf files. Failure to have the latest version of Acrobat Reader installed on your system may result in the inability to view the downloaded PDF files. The Download Instructions you may have received via Email with your Username and Password include a link to Adobe's Acrobat Reader Download Website.
There is no installation process for TPC on your Macintosh computer. Your download is a single Adobe PDF file that runs under all Adobe Acrobat Readers, version 5.0 and higher. If you have a qualifying version of the Reader correctly installed on your Macintosh, simply opening the TPC PDF file will also launch your Acrobat Reader.
You should not use your internet browser to run The Photo College on your local hard drive. Trying to run your installed version of The Photo College within a browser window may result in bad links or a possible lockup of your system. If you lock your system in error, simply reboot and open The Photo College using Adobe Acrobat Reader.
Email support is normally consistent on a Monday through Friday local Florida time schedule. Please keep in mind any difference between your local time and ours - we're -5GMT EST. Our available hours for responding to student's inquiries are not regulated to a fixed work day. We know you can't limit your need for help with a 9 to 5 schedule, so neither do we. Weekend support is a bit more restricted as we have a life, too. We try very hard to remain in touch 7 days per week but there will be times when we will be unavailable to email due only to our access to a quality phone signal while on a shoot or the unpractical application of computer access.
Because of a single piracy incident we now make specific changes to each download so as to identify the source of any violation. TPC is protected by the Copyright Laws of The United States of America and is considered a ‘Licensed’ product. Possession and use of The Photo College Books is the indication of your acceptance of the End-User License Agreement (EULA). The Student ID and Password you may have received is only active for 48 hours. If you are not able to download (where applicable) during that time please email us and we will issue you another. We apologize for any inconvenience.
This OriJen Publications End-User License Agreement ("EULA") is a legal AGREEMENT between you (either as a registered individual or as the registered representative and on behalf of a single entity) and OriJen Publications for the The Photo College software or printed product identified above, which product includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT" and/or "PRINTED PRODUCT"). By installing, copying, or otherwise using either or both PRODUCTs, you agree to be bound by the terms of this EULA.
SOFTWARE PRODUCT LICENSE, PRINTED PRODUCT LICENSE
The PRODUCTS are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCTS are licensed, not sold.
1) GRANT OF LICENSE. This EULA grants you, the registered computer software user, the following rights:
· Applications Software. The SOFTWARE PRODUCT may be used only by you. You may install and use one copy of the SOFTWARE PRODUCT, or any prior version thereof for the same operating system, on a single computer.
· STORAGE/NETWORK USE. You may not store or install a copy of the SOFTWARE PRODUCT on a network server. However, you must acquire and dedicate a distinct license for each person using the SOFTWARE PRODUCT from another storage device. Any given license for the SOFTWARE PRODUCT may not be shared or used concurrently or otherwise on different computers or by different users in a given organization.
· License Pack. If you have acquired this EULA in an OriJen Publications License Pack, you may make the number of additional copies of the computer software portion of the SOFTWARE PRODUCT identified above on this EULA, and you may use each copy in the manner specified above.
2) DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
· Academic Edition Software. If the SOFTWARE PRODUCT is identified as "Academic Edition" or "Educational Copy" or "AE," you must be a "Qualified Educational User" to use the SOFTWARE PRODUCT. If you are not a Qualified Educational User, you have no rights under this EULA. To determine whether you are a Qualified Educational User, please contact OriJen Publications at: sales@thephotocollege.com.
· Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not modify, reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation of components. The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer.
· Not for Resale Software. This SOFTWARE PRODUCT is labeled "Not for Resale" or "NFR" or "Evaluation Copy", and, notwithstanding other sections of this EULA, you may not use the SOFTWARE PRODUCT for commercial purposes nor sell, or otherwise transfer it for value. Commercial purposes include the use of the SOFTWARE PRODUCT in the creation of publicly distributed computer software.
· Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT to any party.
· Software Transfer. You may permanently transfer all of your rights under this EULA, provided you (a) retain no copies, (b) transfer all of the SOFTWARE PRODUCT (including all component parts, the media and printed materials, any upgrades, this EULA, and, if applicable, the Certificate of Authenticity), and (c) the recipient agrees to abide by all of the terms of this EULA. If the SOFTWARE PRODUCT is an upgrade, any transfer must include all prior versions of the SOFTWARE PRODUCT and all of your rights therein, if any.
· Support Services. OriJen Publications may provide you with support services related to the SOFTWARE PRODUCT ("Support Services"). The provision and use of Support Services is governed by the OriJen Publications policies and programs described in the SOFTWARE PRODUCT Readme.txt file and/or in "online" documentation. Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to OriJen Publications as part of the Support Services, OriJen Publications may use such information for its business purpose, including for product updates and development. OriJen Publications will use its best efforts to not utilize such technical information in a form that personally identifies you.
· Termination. Without prejudice to any of OriJen Publications' other rights, OriJen Publications may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
3) UPGRADES. If the SOFTWARE PRODUCT is labeled or otherwise identified by OriJen Publications as an "upgrade", you must be properly licensed to use a product identified by OriJen Publications as being eligible for the upgrade in order to use the SOFTWARE PRODUCT. A SOFTWARE PRODUCT labeled or otherwise identified by OriJen Publications as an upgrade; replaces and/or supplements the product that formed the basis for your eligibility for such upgrade. You may use the resulting upgraded product only in accordance with the terms of this EULA. If the SOFTWARE PRODUCT is an upgrade of a component of a package of software programs that you licensed as a single product, the SOFTWARE PRODUCT may be used and transferred only as part of that single product package and may not be separated for use on more than one computer.
4) COPYRIGHT AND TRADEMARKS.
· All title, trademarks and copyrights in and pertaining to the PRODUCTS (including but not limited to any images, photographs, animation, video, audio, music, text, and applets incorporated into the PRODUCTS), the accompanying, printed or printable materials and any copies of the PRODUCTS are owned by OriJen Publications or its affiliated companies. The PRODUCTS are protected by copyright and trademark laws and international treaty provisions. You must treat the PRODUCTS like any other copyrighted products for archival purposes, and you may not copy the printed or printable materials accompanying the PRODUCTS.
· You may not remove, modify or alter any OriJen Publications copyright or trademark notice from any part of the PRODUCTS, including but not limited to any such notices contained in the physical and/or electronic media or documentation, in the The Photo College Setup Wizard dialogue or 'about' boxes, in any of the runtime resources and/or in any web-presence or web-enabled notices, code or other embodiments originally contained in or dynamically or otherwise created by or contained in the PRODUCTS.
5) DUAL-MEDIA SOFTWARE. You may receive the SOFTWARE PRODUCT in more than one medium. Regardless of the type or size of the medium you receive, you may use only that one medium that is appropriate for your single computer. You may not use or install the other medium on another computer, including but not limited to portable computers under the exclusive control of the registered user. You may not loan, rent, lease, or otherwise transfer the other medium to another user, except as part of the permanent transfer (as provided above) of the SOFTWARE PRODUCT.
6) U. S. GOVERNMENT RESTRICTED RIGHTS. The SOFTWARE PRODUCT and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the U. S. Government is subject to restrictions as set forth in subparagraph C (1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c) (1) and (2) of the Commercial Computer Software Restricted Rights at 48 CFR 52.227-19, as applicable. Manufacturer of the installation software is: InstallShield Software Corporation, 900 North National Parkway, Suite 125, Schaumburg, IL 60173, USA (or by FAX +1-847-240-9120, e-mail to: viresh@installshield.com). Manufacturer of The Photo College PRODUCTS is: OriJen Publications, 8820 E. Neher Ct., Floral City, FL 34436, email to support at thephotocollege dot com using the appropriate jargon.
7) MISCELLANEOUS
If you acquired or use either or both of these PRODUCTS in the United States, this EULA is governed by the laws of the State of Florida. If this SOFTWARE PRODUCT was acquired and is used exclusively outside of the United States, then local law may also apply. Should you have any questions concerning this EULA, or if you desire to contact OriJen Publications for any reason, please contact OriJen Publications at the address or email listed above in section (6).
8) LIMITED WARRANTY
· LIMITED WARRANTY. OriJen Publications warrants that (a) the PRODUCTS will, for a period of one hundred ninety (190) days from the date of your receipt, perform substantially in accordance with The Photo College's written materials accompanying it, and (b) any Support Services provided by The Photo College shall be substantially as described in applicable online materials provided to you by OriJen Publications, and (c) The Photo College support engineers will make commercially reasonable efforts to solve any problem issues with the SOFTWARE PRODUCT. To the extent that implied warranties on the PRODUCTS are disclaimable, they are disclaimed hereinbelow. Some states and jurisdictions do not allow disclaimers of or limitations on the duration of an implied warranty, so the above limitation may not apply to you. To the extent implied warranties may not be entirely disclaimed but implied warranty limitations are allowed by applicable law, implied warranties on the PRODUCTS, if any, are limited to one hundred ninety (190) days.
· CUSTOMER REMEDIES. OriJen Publications' and its suppliers' entire liability and your exclusive remedy shall be, at OriJen Publications' option, repair or replacement of the component(s) of the PRODUCT(S) that do(es) not meet OriJen Publications' Limited Warranty. This Limited Warranty is void if failure of the PRODUCT(S) has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Outside of the United States, neither of these remedies nor any product support services offered by OriJen Publications are available without proof of purchase which includes, but is not limited to, the original SOFTWARE ordering information provided to OriJen Publications/The Photo College at the time of ordering the SOFTWARE package. This information is required for owner/rights verification.
· NO OTHER WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OriJen Publications AND ITS SUPPLIERS DISCLAIM ALL, OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE PRODUCT AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.
9) LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OriJen Publications OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF OriJen Publications HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, OriJen Publications' ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT OR TEN UNITED STATES DOLLARS (U.S. $10.00). BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
10) RETURN POLICY. Returning Books to OriJen Publications
OriJen Publications will accept the return of new undamaged "The Photo College Books" that have not been special ordered (such as a gift, dedication, or a donation), obviously handled or read, disassembled, or otherwise used, subject to the following noted limitations:
For a refund (excluding shipping, packaging, handling, and insurance charges, any extra International postal charges, and a 15% restocking fee are not refundable), Books must be returned postmarked within 15 days of receipt (confirmed by the USPS Confirmation Delivery) in original condition and in original packaging, accompanied by proof of purchase. Refunds will be processed in the original form of payment. All returned merchandise must show a Return Authorization Number (RAN) clearly marked on the outside of the package. Please contact our Customer Service Department via the "Contact TPC" link on The Photo College's Homepage to obtain an RAN. OriJen Publications will not accept a returned Book without first issuing a RAN to the customer.
The Photo College Software Downloads are not refundable. If you are in doubt as to the useable content of an OriJen Publication, we suggest you follow and read fully every link on The Photo College's Website before placing a Software Download Order from OriJen Publications; The Photo College fully tests every Download before release for downloading. Resolving hardware or software problems on the customer's computer system will gladly be assisted by The Photo College Staff.
Returned Books are visually inspected upon receipt for signs of wear prior to the issuance of any refunds, exchanges or credits. All new Books returned to OriJen Publications for refund must be unblemished and in it's original packaging, and must qualify as being resaleable as a pristine and brand new Book; otherwise the item(s) will not be accepted for refund.
Please label both the outside of the package and an inside notice with the RAN received from OriJen Publications, then post the Book(s) prepaid and insured for the full purchase price against loss in transit via the United States Postal Service, to:

OriJen Publications is not responsible for any Book that it does not actually receive, or that is not returned in accordance with the terms of this Policy. Please contact our Customer Service Department via the link on The Photo College's Homepage if you have any questions or concerns.
If you receive a Book(s) that is defective (as determined solely by OriJen Publications) or not as ordered, we will, at our sole option, either refund or credit you up to $12.00 in shipping/handling costs promptly upon our receipt and inspection of the defective or mis-delivered merchandise. All shipping/handling refunds will be determined by OriJen Publications on a case by case basis.
